City Council Approves PROP Ordinance Amendments
The Raleigh City Council voted 5-3 today to give final approval to changes to the Probationary Rental Occupancy Permit (PROP) ordinance.
The new rules will go into effect Jan. 5, 2009. Under the changes:
- All landlords in Raleigh will be required to register their rental property with the City of Raleigh. The annual registration fee will be $30 for the first rental unit and $10 a year for each additional unit in the same building or complex. Failure to register will result in a $50 daily fine for the first violation and a $100 daily fine for the second violation. The maximum civil penalty will be $2,000 per month;
- Civil fines of $100 could be issued to tenants for noise and nuisance party violations;
- The commission of certain crimes at a rental dwelling by tenants will be added to the PROP ordinance. Those crimes are: prostitution, possession of stolen goods, violations of some state alcohol and liquor regulations, unlawful weapons, unlawful possession of a firearm by a felon, gaming violations, and disorderly conduct; and,
- All of Raleigh’s rental properties, regardless of the number of units at a singular location, will fall under the guidelines of the PROP ordinance.
The City Council initially approved the PROP ordinance in 2005. The ordinance requires landlords to obtain a PROP, pay $500 a year for two years and attend rental management classes if he or she has violated unsafe building, minimum housing, zoning or noise or party nuisance ordinances at a rental site and has failed to bring the property into compliance by a City-established deadline. Landlords who have a pattern of repeat citations at a rental property also must get the permit. The permit prohibits the landlord from renting the property until it is brought in compliance with City code. The goal of the PROP ordinance is to assure better quality rental housing for tenants and the surrounding neighborhood.
