THE CITY OF RALEIGH NOTICE OF PUBLIC HEARING TO CHANGE THE ZONING ORDINANCE, CITY CODE, AND COMPREHENSIVE PLANOF THE CITY OF RALEIGH

Notice is given that a joint meeting of the Raleigh City Council and Planning Commission is to be held on Tuesday, April 20, 2010 at 6:30 p.m. in the Council Chamber of the Avery Upchurch Municipal Building.  Public hearings will be conducted to consider changing the City's zoning ordinance and map and to amend the City's Comprehensive Plan.

The City Council may rezone any of the properties described below or any part thereof to any zoning classification, which is more restrictive, including applicable overlay zoning districts.  It may also consider and adopt proposed amendments to the Zoning Ordinance and City Code as amended in any manner, following public hearing.

NOTE:  Copies of all zoning map amendments and conditions for rezoning requests are on file with the Raleigh City Planning Department and /or can be accessed via the internet at www.raleighnc.gov/zoning.

ZONING CASES

Z-5-10 T.W. Alexander Dr., southeast quadrant of its intersection with Sporting Dr., being Wake Co. PIN 0768084863. Approx. 1.55 acres is requested by Brier Creek Assoc. LP to be rezoned from Thoroughfare District Conditional Use to amended Thoroughfare District CUD. The proposed conditions prohibit specific types of uses. Z-7-10 Tryon Road,  southeast of its intersection with Trailwood Drive., being Wake Co. PINs 0792068630, 0792160547 and 0792163571. Approx. 3.4  acres is requested by Smith Family Irrevocable Unitrust to be rezoned from Neighborhood Business, Office and Institution-1 and Residential-10 with Watershed Protection Overlay to Residential-15 Conditional Use. Z-8-10 Cross Link Rd., northeast quadrant of its intersection with Dandridge Dr., being Wake Co. PIN 1712270049.  Approx. 1.18 acre is requested by Henry L. and Marjorie M. Niles to be rezoned from Buffer Commercial to Neighborhood Business Conditional Use District.  The proposed conditions prohibit certain uses; limit lighting, building height, driveway access, and additional retail square footage; and provide a transit easement. Z-9-10 Falls of Neuse Rd., southeast quadrant of its intersection with Durant Rd., being a portion of Wake Co. PIN 1718853179.  Approx. 1.16 acre is requested by Kohl’s Department Stores, Inc., to be rezoned from Shopping Center Conditional Use District to Shopping Center Conditional Use District (amended conditions).  The proposed conditions retain some existing conditions [those which limit vehicular access, building height, and exterior lighting; screen mechanical equipment; prohibit certain uses; detail streetyard plantings; restrict delivery hours by large trucks; and require air filtration for open-flame cooking]; while removing those which require minimum department store sales area sizes, a decorative gate house, a unity of development plan, planted berm adjacent to residential properties, and limit of two outparcels at the SC district’s southwest.  (Staff Contact: Doug Hill, 919-516-2622, doug.hill@ci.raleigh.nc.us)
